This page is a draft prepared before the official release and is not yet effective. Billing, content-use restrictions and task-data retention rules have been determined. Data cleanup and account deletion procedures still need to be implemented, and remaining matters, including third-party processing arrangements, still need verification. An effective date will be stated upon official publication.
1. Service and operator
WherePhoto is provided by AstraPlay Games LLC and helps users investigate possible shooting locations using photos, additional clues and public sources. Contact email: mail@where.photo.
Once the final agreement is published, read it before using the service, together with the Privacy Policy. This page is a draft awaiting confirmation. It does not mean the app is available in stores or that all planned features are live.
Operator address: AstraPlay Games LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States.
2. Nature of the analysis results
WherePhoto provides photo location analysis. It does not guarantee that every analysis will find a location or that a location estimate will be precise. Results may be incorrect, incomplete or unable to identify a location. A task completing normally does not mean a location was successfully found. Confidence levels, reference coordinates and area estimates do not guarantee accuracy or confirm the exact shooting position. Paid credits cover the analysis service, not a guaranteed successful location result.
Independently verify important results. Do not use the analysis as a basis for emergency rescue, legal evidence, entry into private premises or tracking individuals. Specific seats, floors or shooting times can only be determined when supported by evidence.
3. Content you submit
Submit only photos and information you have the right to use and process, and respect others’ privacy, likeness rights and intellectual property. To perform the task you request, the service needs to receive, store and analyze this content and may use relevant third-party services to process it. See the Privacy Policy for the scope of processing.
You retain the rights you lawfully hold in submitted content; submitting a photo does not transfer its ownership. You grant us only the limited permission needed to receive, store, process and display the content to complete your requested analysis task and provide you with related records. We will not use this content for marketing displays or model training.
4. Acceptable use
- Do not use the service to harass or stalk others, disclose sensitive private locations or infringe others’ rights.
- Do not submit unlawful content or malicious files, or interfere with normal service operation.
- Do not bypass access permissions, payment verification or service limits to access accounts, photos or results that are not yours.
- Handle sensitive content involving personal safety, private homes and similar matters with care, and comply with applicable law.
5. Accounts and purchases
Versions offering sign-in may use Apple or Google accounts. Keep your credentials secure and promptly report unauthorized use. Accounts from different sign-in providers are not necessarily merged automatically.
If a version offers paid credits or other purchases, the product, price and applicable rules should be shown before purchase. The actual store listing and purchase confirmation screen apply. This informational website does not accept payments.
If a charged task fails, we restore the credits deducted for that task. A task that completes normally but cannot identify a location still consumes the analysis credit. An unlocated result and a task execution failure are different outcomes. Restoring credits replenishes your available account balance; it does not mean refunding the purchase payment. Rules for monetary refunds, credit validity and remaining credits after account deletion still need to be defined before the official release. Your statutory consumer rights are unaffected.
6. Service changes and liability
Networks, system maintenance, third-party services and source availability may affect task submission, analysis or access to results. Keep your original photos. This service is not a photo backup tool.
Access may be restricted in the event of misuse, security risks or service changes. Specific notice, dispute and restoration procedures will be defined in the final agreement. No final liability provision should exclude rights that applicable law does not allow to be excluded.
7. External services and intellectual property
Maps, public reference materials, sign-in providers and app stores are provided by their respective operators and subject to their own terms. External links aid verification and do not mean WherePhoto owns or guarantees third-party content.
The WherePhoto brand, interface and service content are protected by applicable intellectual property rules. Rights in third-party content and user photos remain with their respective holders.
8. Privacy, disputes and contact
For personal information processing and data requests, read the Privacy Policy. For questions about the service or this agreement, contact AstraPlay Games LLC at mail@where.photo.
Age requirements, the method for notifying significant changes to the terms and the effective date still need to be defined before the official release. Once account deletion and automatic task-data cleanup are available, we will update the relevant descriptions to reflect their actual operation.
9. Governing law and disputes
This agreement is governed by the laws of the State of Wyoming, United States, and applicable United States federal law. This choice of law does not deprive consumers of protections afforded by applicable mandatory laws of their place of residence. Disputes are to be handled by courts with lawful jurisdiction. This agreement does not restrict consumers from bringing proceedings before courts in their place of residence where applicable law permits. You may first seek a resolution through the contact email on this page, but contacting us is not a prerequisite for exercising your legal rights.
10. Language versions
The English versions of this agreement and the Privacy Policy are the primary versions. Other language versions are provided for convenience. If language versions are ambiguous or inconsistent, the English version prevails to the extent permitted by applicable law. This arrangement does not limit rights under mandatory law, including applicable requirements to provide information in a local language. All versions should reflect the same data-processing and commercial rules.
